"PENTEL HAWAIIAN ART" SWEEPSTAKES OFFICIAL RULES This Sweepstakes is intended for viewing and participation in the United States only and shall be evaluated and construed in accordance with the laws of the United States. This Sweepstakes is restricted to entrants who are legal residents of and reside in the 50-United States and District of Columbia only and are 18 years of age or older at time of sweepstakes entry. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE OR INCREASE YOUR CHANCES AND/OR ODDS OF WINNING To enter the "Pentel Hawaiian Art" Sweepstakes; (1) log-on to arts.pentel.com ("Web Site") between 12:01 am (ET) on July 15, 2006 and 11:59 pm (ET) on March 1, 2007 (the "Promotion Period") and follow the prompts to complete, in full, the Official Online Entry Form, and then press "submit" to automatically submit your entry. Limit of one (1) entry per e-mail address or per person during a 24-hour period. Multiple entries by an entrant will invalidate all entries by that entrant. For an entry to be accepted, entrant must submit a valid e-mail address. No electronically mass-produced or multiple entries allowed. Prizes and Approximate Retail Value: One (1) Grand Prize of a 7-night Hawaiian Cruise for 2-people will be awarded. The 7-night cruise includes: round roundtrip coach airfare for two 2-adults from major airport nearest winners home to Honolulu, Hawaii; round trip airport transfers to the port; cruise ship double occupancy stateroom for two (2) people; on-board meals. Trip cancellation insurance, aboard-ship beverages, gratuities and all other expenses not specified herein and all off-ship tours & ground transportation, off-ship meals, beverages and gratuities and all other expenses not specified herein are the responsibility of the winner. Grand Prize Trip must be taken and completed in its entirety by December 31, 2007 with arrangements made a minimum forty-five (45) days in advance of travel or prize will be forfeited in its entirety. No prize substitution or alternative prize will be allowed except as provided herein. Sponsor reserves the right to substitute a Prize of equal or greater value should the advertised Prize be unavailable. Grand Prize winner and guest will be required to execute and return, within fourteen (14) days of Prize notification, a notarized affidavit of eligibility and release of liability and publicity (where permitted by law). If guest of Grand Prize winner is a minor, guest's parent or legal guardian must sign and return all required documents and must accompany guest on Grand Prize trip at his/her own expense, if not the Grand Prize winner. Return of any Prize or Prize notification as undeliverable will result in forfeiture of prize and selection of an alternate winner. Failure to comply with any requirement of the Sweepstakes rules may result in forfeiture of Prize and selection of an alternate winner. Drawing: Grand Prize winner will be selected in a random drawing from among all eligible entries received. Odds of winning a prize depends on the total number of eligible entries received. Drawings will be held on or about March 9, 2007 and will be conducted by Anthony & Associates, an independent judging organization whose decisions are final and binding in all matters regarding this promotion. Eligibility: Sweepstakes open to legal residents of the 50 United States and District of Columbia and who are 18 years of age or older except employees of Pentel of America, Ltd, their respective affiliates, subsidiaries, sales reps, wholesalers, distributors, printers, advertising and promotional agencies and members of the immediate families (parent, child, sibling and spouse) and households of each who are not eligible to participate or win a prize in the sweepstakes. All entrants, as a condition of entry, agree to be bound by these official rules and the decisions of the judges. All prizes will be awarded provided enough eligible entries are received. By accepting a prize, winners consent to the use of their names and/or likenesses for advertising and promotional purposes without additional compensation or notice except where prohibited by law. Winner will be solely responsible for paying all applicable federal, state or local taxes on prize based upon the value of the prizes as set forth in these rules. No prize transfers, cash redemptions or substitutions except Sponsor may substitute a prize of greater or equal value in the event the advertised prize becomes unavailable. Sponsor is not responsible for the failure or unavailability of hardware, software, electronic communications, interrupted or unavailable network server or other Internet connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the Sweepstakes. Sponsor is not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human errors which may occur in the processing of any entries in this Sweepstakes. Persons found tampering with or abusing any aspect of the Sweepstakes, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. Any entrant who attempts to play with multiple e-mail addresses, under multiple identities or uses any other device or artifice to play multiple times or to interfere with the proper play of this Sweepstakes, will be disqualified from participation in the Sweepstakes. If in the judgment of Sponsor, the Sweepstakes is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Sweepstakes, Sponsor reserves the right, in its sole discretion to discontinue, suspend, terminate or modify the Sweepstakes. In the event of any such discontinuation, suspension, termination or modification, the winners of any remaining prizes not yet won will be determined from among all eligible entries received to date that are unaffected by the problem, in a random drawing to be conducted by the judges following the discontinuation, suspension, termination or modification of the Sweepstakes. By entering this Sweepstakes, entrants agree that each entry becomes the property of Sponsor and that such entry may be used by the Sponsor for any proper purpose.
